A landmark Justice Department ruling before Christmas that seems to have opened the door to online gambling has some New Jersey lawmakers ready to rush into legalizing Internet betting.

But before legislators get behind the plan of State Sen. Raymond Lesniak (D., Union) to make New Jersey "the Silicon Valley of Internet gaming," someone should note that most state residents oppose online gambling.

The roughly two-thirds of voters, who for the past two years have voiced objections to Internet betting when asked by Fairleigh Dickinson University pollsters, clearly grasp the risks of mouse-clicking through the rent money.

Even poll respondents who visit Atlantic City casinos, play office pools, or support legalizing sports betting took a stand against online wagering. With good reason, the expansion into cyberspace gives people pause.

Internet betting proponents say the use of credit cards would keep gamblers from exceeding their limit. But a determined problem gambler surely will find ways to game the system.

Meanwhile, the ease of placing a wager by using any computer or smartphone could lure many more people into gambling. And unlike gambling at bricks-and-mortar casinos, online betting offers no multiplier impact on the local economy from dining and other casino-related spending.

The best course for Trenton lawmakers, and those in other states pushing online betting, would be to move with caution. But that may prove to be a naive hope in a climate where few states haven't turned to gambling to help pay for public services.

Lesniak's proposal, for instance, would levy a 10 percent tax on gaming revenue. He also holds out the further enticement of restoring $20 million a year in aid that horseracing tracks lost when Gov. Christie let Atlantic City casinos keep those funds to offset the impact of competition.

However, an expansion into Internet games of chance that are now the sole purview of offshore operations would include a heavy price in social costs. For that reason, any online gambling proposal must be subjected to full public debate, especially in a state where the average citizen isn't so sure playing that hand is a safe bet.

The West Virginia Lottery Commission is assessing how it will react to a U.S. Department of Justice decision that makes online gambling legal, Director John Musgrave said.

Although the decision allows online gambling (but not sports betting), the Lottery Commission would need state legislation before it could proceed.

"We have not prepared anything to submit to the Legislature," Musgrave said.

"We see some opportunities -- offering some incentives with Powerball, our instant tickets, putting some things on our website to benefit our players here in West Virginia that we couldn't do before," he said.

Asked how this might work, Nikki Orcutt, the lottery's deputy director of marketing, said Powerball second-chance drawings are an example. Instead of mailing in a losing ticket to enter the drawing, a player could enter online.

This would protect the retailers because players would still have to buy their Powerball ticket there. But an online drawing would be more convenient because players could enter using any computer, tablet or smart phone that is connected to the Internet.

"The younger player base is not much interested in doing anything if it doesn't happen at their fingertips," she noted.

Musgrave said, "Some states are talking about putting Angry Birds (a popular puzzle video game) on their website. There are all kinds of different things surfacing. We're looking at those to see what might be in the best interest of our jurisdiction."

Pick up the phone, dial a few numbers, and tell the person at the other end of the line you were thinking about making a trip. Within an hour, a jet is scrambled and crews rush to pick you up, flying you to Atlantic City International Airport in comfort and style. When you’re finished, that night or whenever, the casino jets you back home.

For most people, this sort of travel is a dream. But for a handful of top players, it is a way of life.

Atlantic City’s casinos have long treated their top players far differently than other gamblers. The gaming halls cater to the whims of their high-rollers, getting them the best food, tickets to the best shows and keys to the swankiest accommodations. They also get the best travel, including chauffeured jet service to and from Atlantic City.

While some of the gambling halls have cut back on the travel options, one casino — Borgata Hotel Casino & Spa — owns a pair of jets used to shuttle patrons along the East Coast. Federal Aviation Administration records show Borgata owns two British Aerospace 125s, now sold as Hawker 800s, that have the option of seating about a dozen people and have the ability to travel at a cruising speed of 463 mph, reaching 41,000 feet.

The planes, distinguished by stripes and Borgata’s capital B painted on the tail in purple, can travel between 2,359 and 3,145 miles without refueling, according to The Handbook of Business Aviation.

Joe Lupo, Borgata’s senior vice president of operations, confirmed that the casino owns the jets and keeps the pilots on staff, but would not make the pilots available for interviews, allow access to the planes or even disclose many details of the planes themselves.

Records show the planes typically stay close to Atlantic City, according to FlightAware, a flight-tracking website. Between Aug. 12 and Dec. 12, one plane took off 170 times, but averaged just 36 minutes per flight. The other plane took off 115 times, with an average 43-minute flight. Many of the trips are apparently multileg jaunts, with the website’s records tracking the separate legs of the journey as individual trips.

The records also show the planes were flown mostly along the East Coast. They stopped in New York City-area airports 63 times during that time period, including 28 visits to Teterboro Airport, a popular Bergen County hub for corporate jets. It’s a time saver: A flight from Teterboro to Atlantic City averaged about 21 minutes, compared with about a two-hour drive covering the same ground.

Borgata jets also made 24 visits to Washington Dulles International Airport outside Washington, D.C.; five stops at Trenton-Mercer Airport in Ewing Township, Mercer County; four trips to Raleigh County Memorial Airport in Beckley, W.Va.; and two excursions to Philadelphia International Airport.

The jets can travel far, twice flying to Toronto Pearson International Airport, and on Sept. 17 taking a jaunt to John Wayne Airport in Orange County, Calif., stopping briefly both ways in Salina Municipal Airport in Salina, Kan.

Tropicana Casino and Resort also offers high-end charter flights to certain select players, said Eric Fiocco, vice president of marketing. Fiocco said the casino bet heavily on the high-limit table games market, and many of the top players prefer to fly privately.

Tropicana does not own airplanes, Fiocco said, but its VIP staff works with outside contractors across the country, largely on the East Coast, to bring in players.

The players typically fly on six- to 12-seat, small-to-midsized Lear jets, although for larger parties they can arrange a bigger jet, such as a Gulfstream, Fiocco said. There are typically televisions on flights and a stewardess on board the larger planes.

“The best amenity is it is private.” Fiocco said. “You’re getting right to the plane and to your destination without having to go through security screenings.” And when the plane arrives, a car awaits to take the customer straight to the casino, he said.

All this can be done quickly. With sometimes as little as an hour’s notice, the casino can arrange for a jet and get a high-roller headed to the resort.

Fiocco would not say how much the casino pays for this service, nor would he allow the customers to be interviewed.

“These people are such high-visibility people they would not want to be quoted,” Fiocco said.

TWC Aviation, based in San Jose, Calif., is one of about a half-dozen aviation companies approved by New Jersey regulators to do business with the casinos. The company trades on convenience, company Vice President Scott Cutshall said.

“You don’t have to get to the airport two hours before the flight, you don’t have to go through secondary screening, you don’t have to wait to pick up a rental car or wait for your bags,” Cutshall said.

Most companies rent the planes by the hour, Cutshall said, with smaller planes such as the four-seater Cessna Citation Mustang costing between $1,700 and $1,800 per hour. Larger jets, such as as a Boeing Business Jet — essentially a 737 reconfigured for luxury accommodations — run between $10,000 and $15,000 per hour.

A number of other companies also handle flights for the casinos, treating customers to the convenience of jet travel in hopes of separating the players from their wallets.

The largest charter company in the region is Margate’s Gold Transportation, a company incorporated in 1982 to provide air transportation services to the nascent casino industry. The company, like other public charter companies, arranges air transportation for groups of passengers through set air carriers.

On its website, the privately held company said it has arranged more than 1,500 flights for its customers, with 95 percent of the flights for Atlantic City properties. The company also claimed more than 200,000 tourists arrive and depart on Gold flights.

Tapping an online audience hungry for casino gaming was seen as a legal long shot, but a ruling made public late last month out of the federal Justice Department has New Jersey lawmakers seeing it as a sure bet.


Essentially, the Justice Department ruled as long as all gaming activity is in state, and does not include sports events, the activity is subject to the state’s own laws. The legal opinion concerned online lottery ticket sales, but has broad implications in markets like Atlantic City, which has a chance to be on the forefront of taking gaming beyond casino doors.

It’s critically important to put Atlantic City at the forefront of such an opportunity. It’s hard to estimate the size of the online gaming market, but no one is underestimating it as a force — billions of dollars a year that leave New Jersey and the nation to European gaming companies. That’s money that could be used to fill budget gaps, solve employment problems and prop up casinos.

When a bill to legalize online gaming in New Jersey came across Chris Christie’s desk last year, he shot it down over the legal complications, and said it wasn’t the way to “continu(e) the progress that we have made so far in reversing the fortunes of the casino industry in New Jersey.” But even though Christie has been a crusader for the casinos, there’s been very little progress to speak of. Each month, Pennsylvania’s casinos eat a little more of Atlantic City’s lunch; in November, the Keystone State’s 10 gaming facilities took in more revenue than Atlantic City’s 11 for the first time. No one expects it will be the last time.

With the federal hurdle out of the way, lawmakers and Christie have to put their heads together and come up with a policy that will allow the casinos access to online gamers. If not, it will be the latest missed opportunity in a market that’s running out of chances to rebuild itself.

Nevada gambling revenues jumped 7 percent in November compared to the year-ago period, with baccarat driving gains and other games and betting options showing increases, state regulators said Wednesday.

Winnings were up 9 percent on the Las Vegas Strip, with casinos pulling in $495 million in gambling revenue, according to the monthly report issued by the Nevada Gaming Control Board.

Downtown Las Vegas casinos posted a 7.2 percent increase, with $47 million in revenue in November.

Reno saw a slight, 0.7 percent increase compared to the same period last year, while bringing in revenue of $38 million in November. Washoe County, which includes Reno, saw winnings rise nearly 2 percent to $53.5 million because casinos were luckier than gamblers.

However, November marked the 20th consecutive month that volume of play declined in the northern Nevada market.

South Lake Tahoe revenue fell almost 7 percent as casinos won $14 million, while the $20.3 million won by casinos in Elko County was up 8.4 percent.

Casinos statewide collected $880 million in gambling revenue in November, and the percent gain came as a so-called easy comparison to November 2010, when statewide winnings declined 6 percent.

Special events at Strip resorts contributed to increased casino action, said Mike Lawton, senior analyst with the control board.

He pointed to concerts by the Eagles and Katy Perry; the Manny Pacquiao fight against Juan Manuel Marquez; and the final table event of the World Series of Poker.

"Just going into the month with those events, plus the easy comparison, we would expect to see these types of results," Lawton said.

Tax collections based on the November win was $57 million, representing a 15.2 percent increase compared with the same time last year. Tax collections don't always mirror percentage increases or losses in winnings because many bets are made on credit, and casinos don't pay taxes on those until the debts are paid.

The "casino win" is what was left in casino coffers after gamblers wagered $10.8 billion on slot machines, card and table games, and sports betting. The $8.5 billion pumped into slot and video poker machines was up 0.4 percent, or $30.8 million, over November 2010, the report said.

Gamblers spent $2.4 billion on table games, an increase of $83.8 million or 3.7 percent during the same period.

Wagers on baccarat, a high roller game favored by Asian players, totaled $657.3 million, up $85.3 million or nearly 15 percent.

Without baccarat, the statewide win would have increased 5 percent, Lawton said.

For the fiscal year that started July 1, the statewide casino win is up 1 percent.

Florida could get three new large casinos, as well as slot machines at every dog and horse track in the state, under a far-reaching gambling bill that passed its first hurdle Monday.

A state Senate panel voted 7-3 in favor of the hotly debated and heavily lobbied bill, but its future remains uncertain amid the avowedly staunch opposition to the expansion of gambling by top House Republicans.

When the bill was initially filed late last year, it was primarily focused on bringing casinos to South Florida that could lure out-of-state tourists and spark jobs since each casino operator seeking a license is required to spend at least $2 billion. Sen. Ellyn Bogdanoff, R-Fort Lauderdale and sponsor of the measure, promised that her bill would go hand in hand with an effort to rein in other types of gambling going in the state.

But Bogdanoff was forced to make concessions to the state's pari-mutuel industry, which retains political clout in Tallahassee, in order to move the legislation along.

So the bill approved on Monday now gives dog tracks and horse tracks located in the same counties with the large casinos, or destination resorts, a chance to offer the same games such as blackjack without having to make the same $2 billion investment. These tracks would also pay the same lower tax rate as the casinos.

The legislation also would allow dog tracks and horse tracks in other parts of the state to offer slot machines. It also makes it clear that the large casinos would no longer be limited to just South Florida but would be allowed anywhere in the state.

Voters in each county would have to vote to allow the different types of expanded gambling, but the bill does not require an up or down statewide vote on casinos.

For some lawmakers it was just too much. The casino bill is already staunchly opposed by a diverse coalition of groups including Disney World, the Florida Chamber of Commerce and groups such as the Florida Baptist Convention.

"This bill now to me represents the largest expansion of gambling that I have ever seen in the country," said Sen. John Thrasher, R-St. Augustine and one of the three no votes against the bill.

Added Sen. Charlie Dean, R-Inverness: "I think we're reaching way too far; we've gone too fast and in too big a hurry."

Bogdanoff conceded she has "lost" the argument that the legislation does not expand gambling in Florida, which besides existing dog and horse tracks also includes a state-run lottery and casinos run by the Seminole Tribe of Florida.

But she predicted that the legislation would cut down on the "proliferation" of gambling that has occurred in recent years because it would also block any new pari-mutuel permits - similar to one that was recently handed out for a barrel-racing operation in Gretna. She also said it would prevent the addition of anymore Internet cafes, which are sweepstakes operations run out of storefronts and whose legal status has been questioned.

"This is a big lift and there's a lot of stuff in here. Call it what you want. Call it an expansion. Call it a reform. Call it a redirection," Bogdanoff said.

The first stop of the bill before the Senate Regulated Industries Committee attracted a large number of detractors as well as supporters who said the legislation was needed in order to bring much-needed jobs to a state that still has double-digit unemployment.

Sen. Miguel Diaz de la Portilla, R-Miami, brushed aside criticism that the bill would take away from Florida's family-friendly atmosphere and said lawmakers should vote for it.

"It isn't every day in this economy you have companies stepping forward willing to spend billions," said Diaz de la Portilla.

The bill must clear two more committees in the Senate before it would head to the full Senate. But Thrasher, who is the powerful chairman of the final committee stop, predicted the measure may not move much further until the Florida House signals if it is willing to pass a similar bill.

Rep. Eric Fresen, R-Miami and the House sponsor, predicted on Monday that a House panel would take up the legislation next week. But even Fresen stopped short of saying whether or not he had the votes to get the legislation passed in that chamber.

While Republicans have been divided about the bill Gov. Rick Scott has refused to take a firm stance on whether he would sign the bill should it eventually land on his desk.

Richard Haddrill, CEO of Bally Technologies, is the new head of the American Gaming Association (AGA), after being elected to the position at last month's annual meeting of the gambling industry's representative body.
Influential Body

Haddrill's election is timely, with the issue of gambling still very much in the headlines and before the federal and various state legislatures. AGA president Frank Fahrenkopf, Jr., said he sees Haddrill and new vice-president James Murrell as helping the industry take advantage of the new opportunities in the coming two years.

The AGA represents the commercial casino and entertainment industry on federal legislative and regulatory issues. The association also provides information, and runs educational and advocacy programs, with the aim of showing leadership on industry-related public issues.

Current State of Play

Several states are now looking to push through legislation on online gambling, after the US Department of Justice last month released an opinion reversing decades of previous policy. Previously, it said the 1961 Wire Act banned all wagers across state lines, but in the new opinion it said this applies only to sports betting.

Connecticut is the latest to join the rush, after Governor Dannel P. Malloy said Monday he believes it is inevitable the state will approve online gambling. They will already be playing catch up with other states, as Nevada, California and Iowa have positioned themselves to be the first states to start running nationwide online gambling.

Clearly not everyone is thinking the same when it comes to the future of Nevada and online gambling. Since there are many opinions about the change in the meaning of the Federal Wire Act the voices are speaking and their all speaking in tongues.

When Gov. Brian Sandoval signed Assembly Bill 258 back in June 2011, it directed the Nevada Gaming Commission to adopt regulations and to grant licenses to casinos to be ready to offer online poker if and when the federal government approves it. Now that the time is here, there are many casinos gearing up to finally take the step to the next level and others who are not quite jumping on the bandwagon.

“Come February, you’ll see a lot of activity in Nevada around legal online gaming. Some people will jump, we’ll certainly be ready,” said Castle, who joined Shuffle Master in October from Zynga. “The question is which companies will want to go first. “It’s just got accelerated. 2012 is going to be a banner year in many ways.”

Not so fast, Deutsche Bank gaming analyst Andrew Zarnett said. In a recent research report, he told investors that the hyped-up enthusiasm expressed by many Internet poker proponents toward the prospects of federal legalization was misplaced.

“We do not feel it provides clarity that the Department of Justice has softened its stance on all Internet gaming,” said Zarnett, who analyzes and researches the high-yield debt of several casino companies.

Still, Zarnett said the debate over Internet poker has evolved from “whether” some forms of the activity will be legalized to “when” Americans would be able to gamble for money on their home computers.

Jennifer Carleton, a shareholder with Brownstein Hyatt Farber Schreck, cautioned that future Justice Department opinions could reverse the latest interpretation.

“Without a doubt, the opinion has significantly altered the gaming landscape with regard to the placing and receiving of wagers over the Internet and possibly opens the door for states to allow online poker and other forms of Internet gambling,” Carleton said. “Gaming practitioners and entrepreneurs interested in Internet gaming must remain alert, attentive and proactive during the period of rapid legislative and regulatory changes that is likely to follow.”

Nevada Gaming Control Board Chairman Mark Lipparelli said further analysis of the opinion is needed. “Clearly, there was a major shift in policy understanding,” Lipparelli said. “But it’s too early to jump to any final conclusion.”

Zarnett said Internet poker would roll out on a state-by-state basis in the same manner as other forms of gambling, including lotteries, horse racing and casinos.

“Already some states are working hard to prepare for-profit online gaming,” Zarnett said. “It is clearer now that not-for-profit state lotteries will be involved, maybe even have a first-mover advantage.”

Lipparelli said the agency has received 10 applications for interactive gaming from casino operators, equipment providers and manufacturers. It’s unclear how long investigative process will take. The technologies being proposed will need proper vetting. “The devil is in the details,” Lipparelli said.
