Convinced that New Jersey’s new online gambling industry can withstand public demand, regulators cleared six Atlantic City casinos to open up Internet wagering to the general public today.

As of early Tuesday morning, New Jersey became the third state in the country — joining Nevada and Delaware — to offer online gambling to the public. New Jersey and Delaware now offer a range of casino games, while Nevada offers online poker only.

While New Jersey may not be first to enter the realm of online gambling, with a population of 9 million and heavily trafficked borders, many experts said New Jersey’s success will be used to gauge how successful the industry can be in the U.S.

Challenges remain as operators will continue to evolve geolocation and identity verification technologies, as well as payment-processing services.

Despite numerous reports of individuals within the state’s borders being incorrectly blocked from play, New Jersey Division of Gaming Enforcement Director David Rebuck said from a regulatory perspective, the systems are performing correctly. He characterized the geolocation issues not as a regulatory problem, but instead an operator challenge.

The soft play roll-out has already been compared by some to the botched website introduction of the Affordable Care Act, a comparison Rebuck opposes. There are no significant regulatory problems or technical barriers to going live, he said.

“People ask me, ‘Are you going to have a meltdown, a failure, in the way Obamacare is happening?’“ Rebuck said. “There’s so many distinctions, it’s almost incredible I have to answer it. ... (Internet) gaming is an entertainment function. It’s not a core life responsibility.”

Regulators have been closely watching as seven Atlantic City casinos and their web partners have undergone real-money trial play limited to 500 concurrent players on each site for five days. Regulators noted the amount of traffic to the sites as a sign of early success. More than 10,000 people have registered for play.

Borgata Hotel Casino & Spa, Bally’s Atlantic City, Caesars Atlantic City, Tropicana Casino and Resort, Trump Plaza Hotel and Casino, and Trump Taj Mahal Casino Resort have all been approved to begin full operations today. All have been issued Internet gambling permits from the state, and their web partners have been issued necessary waivers to begin operations.

Golden Nugget Atlantic City, which has been engaging in testing since Nov. 21, will remain in restricted play, regulators said. Rebuck said the decision was made by the casino after two hours of extensive discussions with the state.

Golden Nugget General Manager Tom Pohlman said the property, which has partnered with Bally Technologies, expects to be approved for public play within a week.

The casino has had issues with slot games freezing as well as reporting issues. Pohlman said the property doesn’t yet feel “confident that numbers reconcile with what’s actually happening.”

“We’re not in a sprint here. We’re in the marathon,” Pohlman said. “The quality of the product and the guest experience is not what we expect as the Golden Nugget. We have decided to continue to test on our own and improve.”

Improvement is expected to continue across the industry beyond the launch.

Joe Pappano, senior vice president and managing director of payment processor Vantiv Gaming Solutions, is continually working with credit card providers and banks to get more companies on board with approving online gambling transactions. Currently, several banks, including Bank of America Corp. and Wells Fargo & Co., will not process the transactions.

Much is expected to change in the next 12 to 18 months in terms of the number of companies accepting online gambling payments, he said.

Meanwhile, the same is true for geolocation services. Providers have said that improvements can be made as their geofences are adjusted. Rebuck acknowledged that while geolocation does perform to regulatory standards, there is some concern about public perception.

“We’ve been inundated with people trying to get on. I’ve been stressing with the geolocation companies we’ve been meeting with that they need to consider options that make their products more efficient,” Rebuck said, adding that he will not put the state “at risk” and lower its standards for geolocation technology.

Atlantic Club Casino Hotel, which recently filed for Chapter 11 bankruptcy protection, and Revel Casino-Hotel have not announced any plans for Internet gambling. Caesars Entertainment, which owns Bally's, Caesars, Showboat and Harrah's, opted to seek Internet gambling permits only for its Bally's and Caesars properties.

According to New Jersey’s online gambling legislation approved nine months ago, online gambling companies must partner with a land-based Atlantic City casino to offer their product in the state.

Plans for a partnership between Resorts Casino Hotel and online gambling giant PokerStars have been announced, but neither has received the necessary state approvals to begin operations. The Division of Gaming Enforcement has said PokerStars’ application remains under review.

Additions to those companies approved for online gambling operations in New Jersey can be made on a rolling basis.

After concluding a multi-day “soft play” period with relatively few incidents of note, New Jersey regulators have decided to go ahead with the full launch of regulated online gambling in the state.

Six casinos have been issued approvals by the NJ Division of Gaming Enforcement to continue with full play.

The Golden Nugget remains in the testing stage.

As a result, the open market for regulated online gambling in NJ is effectively open as of now.

That announcement came from the DGE’s David Rebuck on a conference call at 3pm EST on November 25th.

The soft launch of online gambling in New Jersey was riddled with problems, with the two most common complaints from players being an inability to deposit and faulty geo-location technology that blocked them from playing even though they were located well within New Jersey’s borders.

Will those problems continue now that online gambling is open to the general public in New Jersey?

The answer is almost certainly yes. The real question is the degree to which casinos and regulators will be able to mitigate those core issues.
Banking issues largely out of NJ’s control

The difficulty players have been experiencing depositing is not something that regulators and casinos have much direct control over. At the heart of the problem is the unwillingness of some banks (and companies like PayPal) to process deposits for online gambling – even clearly legal, regulated online gambling.

Casinos will need to take a two-pronged approach on this issue, both pressuring banks to change their policies and coming up with alternatives for consumers (and educating consumers on how to use those alternative deposit options).

Geotargeting should improve – but how much remains a question

Casinos can exercise a greater degree of control over the geo-location tools that are used to determine whether a player is located in NJ.

The consensus opinion is that casinos were being aggressive – perhaps overly so – in their attempts to keep unauthorized players out during the soft launch period, and that as that aggression is dialed back, the number of false positives identified by geo-location tools will decrease.

But even if that ends up being the case, it’s still a given that at least some players in NJ will be locked out of regulated online gambling sites. And casinos could decide that – at least in the early days of the market – there’s more to gain from a cautious approach than a liberal one when it comes to geo-location.

Both Wells Fargo and Discover cited compliance issues with the federal government. PayPal said online gaming is addressed in its policy.

Following the passage of the Unlawful Internet Gambling Enforcement Act in the US, banks ousted gaming transactions from their card-payment systems. Meanwhile, WSOP and Ultimate Poker continue to draw players in Nevada, averaging 23,500 customers.

The American Gaming Association (AGA) has brought on a flurry of new staff and public affairs firms as the battle over Internet gambling heats up.

Geoff Freeman, the AGA’s president and chief executive, said bulking up in staff and consulting are part of his plan to create a more aggressive casino trade association that can operate outside of the Beltway.

“It's part of a big shift that we are making. We are becoming a more proactive group that is working to define the image of the gaming industry. It's less about legislation and more about defining the image of this industry, not in just Washington but in the states as well,” Freeman told The Hill.

That includes bringing on Jim Messina, President Obama’s campaign manager for his 2012 reelection bid. The trade group has hired the Messina Group to help with grassroots campaigns, including support of online gambling.

The most recent statewide survey of registered voters from Fairleigh Dickinson University’s PublicMind finds that the percentage of registered voters who support online gaming has dropped, even though the practice was legalized in November and increasing numbers of players are registering with New Jersey casinos.

One-third (32%) are currently in favor, with 57 percent opposed. The university’s survey research group has asked this question repeatedly over the years, and the current findings represent a decline in favor from those in March 2013. “The public’s attitude was, for several years, warming up to online gambling,” said Krista Jenkins, director of PublicMind and professor of political science, in a statement. “But there has been a clear change in direction, now that the practice has actually been legalized. Part of the public has always shown deep reluctance to make gambling so accessible in their own homes. Now that it is in fact legal, they may be more concerned than ever.”

Those who say they visited a casino in the last 12 months are significantly more apt to support online gambling. Around four-in-ten of these individuals support the legalization, whereas barely a quarter (28%) of those without a recent casino visit say the same. And, women remain more opposed than men. Two thirds of women (67%) reject online gambling’s legalization, compared with around half of men (47%).

“Internet gambling firms operating in New Jersey have been marketing heavily through numerous media outlets to gain recognition in the online gambling space. These numbers may reflect a bit of intolerance to internet gambling due to the nature and volume of advertising about IGAMING recently in New Jersey,” said Donald Hoover, Senior Lecturer of Hospitality Management, in the statement.
