Ohio's incoming casinos won't pay taxes on free betting chips handed to valued customers, under a bill set to be signed into law by Gov. John Kasich.

Giving Ohio casinos such a perk will put them on equal footing with rival gambling halls in Pennsylvania that aren't taxed for promotional or "comped" betting. In the last fiscal year, Pennsylvania casinos "comped" or gave away nearly $510 million worth of bets not subject to tax - almost 2 percent of total betting.

In theory, Pennsylvania gave away up to $25 million in taxes last year by not levying such complimentory betting, but industry experts say casinos wouldn't have been as generous with free bets had the taxes applied. Casinos offer promotional bets as a marketing tool to prompt valued customers to gamble even more - ultimately delivering more revenue, which then is taxed.

House Bill 277 legally establishes several provisions of a compromise that ended a tax fight between Kasich and casino developers. Uncertainty over how much in future taxes the casinos would pay resulted in a 31-day suspension of construction at casino sites in Cincinnati and Cleveland. Work resumed last week.

The compromise included concessions from casino operators to pay the state an additional $220 million over the next decade. In return, the casinos won favorable regulatory decisions including forgiveness of taxation on free bets awarded.

Steve Gallaway, principal of Gaming Market Advisors in Denver, estimates the value of tax-free comped betting might offset the impact of the extra money paid to Ohio, estimating it could boost casinos' revenues 2 percent or more.

"If a neighboring state has free play and yours is taxed, then that (removing the tax) is valuable," he said.

Under provisions of a constitutional amendment approved by voters and legalizing four casinos in 2009, casinos will pay 33 percent of gambling revenue to the state's cities, counties, school districts and other recipients.

The bill also creates an "Operator Settlement Fund" to receive the extra money Kasich won in casino negotiations. The money will be earmarked for workforce development, economic development, job creation, training, education, food banks and other expenses as designated by future appropriations by Ohio lawmakers.

Rock Gaming is developing casinos in both Cincinnati and Cleveland with operating partner Caesars Entertainment Corp. Penn National Gaming Inc. is building casinos in Columbus and Toledo.

The bill also:

No longer subjects casinos to a central computerized record-keeping system, unless the casino fails to comply with Ohio laws. The measure means casinos would not have to invest in an expensive, extra system to back up gambling data.

Loosens ownership disclosures for casinos so that only minority stakeholders with more than 5 percent ownership must be identified. A 2010 law said private companies with as little as a 3 percent stake in casinos had to be disclosed.

Clarifies that casino licenses are renewed every three years and specifies that renewal fees will only cover administrative costs. The measure ensures that Ohio can't charge hefty fees for renewing a casino license, just enough to review the application. Each of the four casinos will pay a one-time $50 million license fee to start out.

Spells out that Ohio's Commercial Activity Tax (CAT) will be applied to gambling revenue, not total betting - removing the threat of higher CAT tax liability that Ohio lawmakers had approved in early versions of the state budget.

Clarifies that casinos can be opened in phases, as Rock Gaming plans in Cleveland. It also says gambling in one or more buildings can be counted as a single casino provided they are connected by property owned or leased by the operator.

Iowa's newest casino along the South Dakota border has gotten off to a fast start, while the statewide gambling industry is slowly rebounding from the recession, according to the Iowa Racing and Gaming Commission.

The Grand Falls Casino Resort, which opened June 9 near Larchwood in northwest Iowa, generated $4.4 million in gross gambling revenue during its first three weeks of business, records show. There were 173,831 admissions.

Statewide, Iowa's 18 state-regulated casinos reported almost $1.38 billion in gambling revenue from 21.7 million admissions over the past 12 months, the commission reported last week. Overall gambling revenue was up 1.1 percent compared with the same period last year. The report doesn't include statistics from three Iowa casinos run by American Indian tribes.

"Things seem to be going in the right direction, but it has been slow, which I think is indicative of the entire economy," said Jack Ketterer, the commission's administrator.

Casino admissions were down 1.8 percent the past 12 months, while the average customer lost about $63.

The Grand Falls operation, a luxury property built at a cost of $120 million, is just six miles from Sioux Falls, S.D., with a metro population of 228,000. On the casino's opening day last month, about 1,200 guests attended a private reception and droves of people poured in when the doors opened to the public.

"It was fun. It was crazy. It was a lot of people. It was interesting to just stand by the door and watch the reaction of people when they saw the facility," said Dan Kehl, chief executive officer of Kehl Management, which operates the investor-owned casino.

Those initial crowds have since leveled off, and work has begun to build a steady base of customers, Kehl said. Preliminary market research shows about 80 percent of the casino's patrons are from out-of-state, mostly from South Dakota and Minnesota, and particularly from the Sioux Falls area. One surprise has been a younger crowd on weekends - people in their 30s who stay late to enjoy themselves, he added.

The state commission approved a casino license for the Grand Falls operation last year, theorizing it was the last untapped casino market in Iowa. Ketterer said that assumption appears to be correct. He believes the Larchwood-area gambling business is on track to generate between $70 million to $80 million in casino revenue annually if the early numbers hold up.

"It's a very nice facility, and it seems to be well received so far," Ketterer said.

Among all of Iowa's casinos, Prairie Meadows Racetrack and Casino in Altoona was the most popular the past 12 months, raking in $189.9 million in casino revenue from 2.43 million admissions. That was slightly ahead of Horseshoe Casino in Council Bluffs, which had $189.2 million in gambling revenue from 2.33 million admissions.

"We are very fortunate. We are just tickled to death that things are going as good as they are," said Gary Palmer, Prairie Meadows general manager. He said construction of a new Prairie Meadows hotel with 169 rooms remains on schedule for a March 2012 opening.

Wes Ehrecke, president of the Iowa Gaming Association, an industry group, said all of Iowa's casinos have been working hard to upgrade their properties and to offer excellent customer service. He said he agrees with those who see some improvement in Iowa's economy.

"I think people have more confidence with their discretionary dollars earmarked for entertainment," he said.

Ehrecke added that Iowa casino industry executives are breathing easier now that the Legislature has adjourned without approving a 50 percent hike in state casino taxes proposed by Gov. Terry Branstad. "That would have been devastating to the industry's ongoing viability." Had it passed, he said, some casinos would have closed or ordered layoffs, he said. Iowa's casino industry employs about 10,000 people.

Tom Timmons, vice president of operations for Wild Rose Entertainment, which operates casinos in Clinton and Emmetsburg, said both businesses have seen revenue increases. The Clinton casino has been aided by construction of a new land-based facility that opened three years ago, replacing an antiquated riverboat casino. The Emmetsburg casino, which opened five years ago, has benefited from better marketing to attract rural customers from 25 miles away and beyond. That includes efforts to draw summer vacationers from the Iowa Great Lakes area, he added.
