America's lingering Great Recession has already yielded a dramatic spike in unemployment rates and unprecedented government debt. Who would have expected it to usher in legalized Internet gambling as well?

In much the same way that some state officials have proposed taxing marijuana to raise money, advocates of legalizing online poker and slots are saying that billions of dollars in new tax revenue could be raised just by changing the law.

Online gambling gives Congress “a huge new source of revenue that is just sitting there on the table,” said Michael Waxman, a spokesman for the Washington-based Safe and Secure Internet Gambling Initiative. The group represents financial services companies such as U.K.-based payment processor UC Group.

Opponents such as Chad Hills, an analyst for gambling research and policy at Colorado Springs-based Focus on the Family, say tax gains would be offset by social costs, such as gambling addiction.

Online betting is “the most predatory, addictive and invasive form of gambling,” Hills said. “If people are sitting around in their pajamas on their computer in their living room playing on multiple Internet sites, what is this going to do to the United States?”

The U.S. offshore Internet gambling market is expected to climb to $5.7 billion in 2010 from $5.4 billion last year, according to U.K.-based H2 Gambling Capital, which supplies data on the industry. The global market is about $30 billion.

$24 Billion

If the U.S. legalizes the gambling, the market could grow to $24 billion in five years, according to H2. That excludes sports betting, which wouldn’t be allowed under House proposals.

The biggest offshore gambling sites for U.S. players include PokerStars, based in Isle of Man, and Full Tilt Poker, based in Ireland, according to H2.

“People will always find a way though some form or another to deposit money and play online,” Pappas said. “That growing reality is why Congress needs to act.”

McDermott’s measure depends on passage of legislation proposed by Representative Barney Frank of Massachusetts, chairman of the House Financial Services Committee, to end a ban on most Internet gambling.

Frank’s bill would scale back a 2006 law that, starting next month, will bar banks from processing payments to offshore gambling websites. Critics of the 2006 law say it makes no distinction between legal and illegal online wagering. Some states allow online betting on horse and dog racing, and California allows lottery tickets to be purchased online.

Safeguards

Under Frank’s proposal, licensed gambling companies would be required to have safeguards to protect against underage and compulsive gambling and to prevent people from placing bets online in states that prohibit it. Such oversight would protect consumers against fraud, identity theft and other crimes, McDermott and other proponents say.

McDermott’s proposal would require Internet gambling operators to pay a 2 percent tax to the federal government on betting deposits and a 6 percent tax to states. The federal treasury also would collect taxes on gaming-company profits, and bettors would pay taxes on winnings.

“The taxing is a momentum, and I think you’re going to get more momentum when the regulations go into effect and the banks have to start doing all this hassle,” Frank said.

Frank said he plans to bring his gambling measure to the Financial Services Committee after Congress finishes separate legislation on rules governing Wall Street.

‘Crack Cocaine of Gambling’

Representative Spencer Bachus of Alabama, the top Republican on Frank’s panel, said he’ll do all he can to defeat efforts to legalize and tax online betting, which he called the “crack cocaine of gambling.”

Bachus said revenue estimates for McDermott’s proposal are bloated because they assume all states would participate. The Alabama congressman said he’s concerned the prospect of more government revenue will attract lawmakers who thus far have opposed legalizing Internet gambling.

The 2006 law to enforce the ban had overwhelming support in the House, passing by a vote of 317-93, with 115 Democrats backing it.

“I know the government is in a search for money, but if you have something that is destructive to society, you shouldn’t let $40 billion be the price tag,” Bachus said.

After four years of regulation amendments and debate, the US government finally enforced one of main aspects of the UIGEA, specifically that financial institutions and banks are now legally required to stop players from wagering in online casinos.

However, according to a report published by Casino City Times, the only online gambling website affected by the introduction of the law is PokerStars. While smaller poker rooms and online casinos are still able to process payments from players who deposit via credit/debit card, PokerStars is currently unable to accept deposits made using Visa cards. John Pappas, chairman of the Poker Players Alliance (PPA) has admitted that he isn’t sure why PokerStars has been singled out, but also noted that “players benefit when the largest, most regulated and highly-reputable sites (such as Poker Stars) are able to process their deposits”.

Critics of the UIGEA have suggested that the legislation will do little to block players from wagering at online casinos. PokerStars aside, it seems that the majority of online casinos and poker rooms have been able to successfully accept and transfer payments from US players.

There are four Internet gaming bills currently before Congress:
1. U.S. Rep Barney Frank, D-Mass., has sponsored a bill that would legalize online gaming and establish regulatory provisions.
2. U.S. Rep Jim McDermott, D-Washington, has sponsored a bill to tax online gaming and customers' winnings. It is estimated that the bill could net as much as $72 billion in taxes during 10 years, with $42 billion going to the federal government and $30 billion going to state governments.
3. U.S. Sen. Robert Menendez, D-N.J., has proposed the legalization of poker and other games of skill. This bill is commonly called the poker carve-out bill.
4. U.S. Sens. Ron Wyden, D-Oregon, and Judd Gregg, R-N.H., have introduced a bill that would restructure the Internal Revenue Service code. A subset of the bill would legalize Internet gaming as a new source of tax revenue for the federal government.

While their are still some issues to work out before legalising online casino games, the government is ready to license and regulate the online sports betting industry. Unfortunately, its not going to happen to well after the World Cup, and probably sometime within the first few months of 2011. Greece will likely draft legislation that is similiar to France or Italy where their are strict requirements for gambling operators to begin offering online gambling to Greek citizens.

The member states that require licensing for the organisation and promotion of games of chance and those that prohibit online games of chance will welcome the Court of Justice decision handed down on 3 June. The Luxembourg-based court ruled that even though such legislation constitutes a restriction of the freedom to provide services, it may be justified, considering the specific features of this type of service, by the objective of combating fraud and crime.

The Unlawful Internet Gaming Enforcement Act was passed after midnight on the final day of congressional action prior to the 2006 election. The bill was never debated – heck, it was never even read by any of the congressmen who voted for it. Tennessee Republican Bill Frist was courting right wing anti-gaming interests in a last ditch effort to run for president when he attached the UIGEA as a rider to a ‘must pass’ Port Security bill. Frist’s ploy worked, and UIGEA became law, but Frist paid the price for his backhanded maneuver. His presidential run never got off the ground, and he’s no longer in politics today.

Nevada Gaming Control Board (NGC😎 is telling Las Vegas casinos not to get involved with online gambling until state or federal legislation is passed that makes online gambling a legal activity. The NGCB has issued this warning because it is rumored that many of the Las Vegas casino giants are already aligning with online casino operators to make a smooth transition into the online gambling industry once the US Congress decides to license and regulate the industry.
