The ongoing saga involving Full Tilt Poker and the lawsuit brought against the online poker room by the US Department of Justice has only strengthened US Rep Barney Frank’s determination to see momentous changes in the country’s online gambling system.

Barney Frank, who is one of the most outspoken supporters of changes to the UIGEA and other archaic gambling laws in the United States spoke about recent information regarding the DOJ’s accusations that Full Tilt Poker worked as a Ponzi scheme and fleeced hundreds of millions of dollars from its players. “I was very disappointed to hear of the allegations,” he said.

“But it doesn’t change my views,” he said. “If anything, it strengthens it.”

Frank found himself in hot water recently after a Boston newspaper revealed that Full Tilt Poker had made an $18,000 contribution to the politician’s campaign in the past. It also named other representatives as having received contributions. Some of Frank’s critics have blasted him for cooperating with criminals and accepting contributions from online gambling groups that were not technically legal in the United States.

“Frank should refund every nickel of the tens of thousands in campaign donations linked to online gambling,” said Tim Buckley, speaking for the Massachusetts GOP.

Barney Frank promised to return all the money that he received from Chris Ferguson, Rafael Furst and Howard Lederer if the three were convicted for fraud. Frank said that he would donate the money to a fund for Full Tilt Poker victims should one be set up, or – if not – to charity.

With the PokerStars World Championship of Online Poker (WCOOP) coming to end, most online poker players would normally be looking forward to the next Full Tilt Online Poker Series (FTOPS) to find that next poker tournament series excitement. Qualifiers will be available for each event with a $55 buy-in or higher. As is the usual for PartyPoker, qualifiers will start very low, for as little a one dollar, and will have a ladder-type structure as players work their way up to win a seat in a Pokerfest event. Those who win seats can enter any event with the corresponding buy-in.

There will be three Pokerfest leaderboards, one each for events with points buy-ins, low buy-ins, and high buy-ins. Players will earn points based on tournament finish and the amount of the buy-in. The total prize pool for the points buy-in leaderboard will be $5,000 with a $500 first prize, for the low buy-in leaderboard there will be a $30,000 prize pool and $2,500 first prize, and for the high buy-in leaderboard there will be a $65,000 prize pool and $5,000 first prize.

Pokerfest will also feature Side Events so that players can win extra cash:

$35,000 Pokerfest Jackpots – The first person to win three Pokerfest events will win $20,000, the first person to reach the final table in 10 events will get $10,000, and the first person to cash ten times will win $5,000.
Daily Dollar Side Events – Starting October 23rd, PartyPoker will hold two daily $1 buy-in tournaments, but each tournament will have a special twist that can only be found in the tournament lobby.
Prize Draw – Every player will win a raffle entry for each event in which they play. The first 500 names drawn will win prizes such as iPads, chip sets, and other merchandise.

If you watch poker on TV, you've probably seen Chris Ferguson, whose long hair, beard and forgiving eyes led to his nickname, Jesus. And you've probably seen Howard Lederer, the cerebral player known as the Professor.

Both seem like guys you'd enjoy sitting down with for a game of cards. And that's sort of what thousands of people did - in a virtual way - at the online gambling site Full Tilt Poker.

The site was shuttered in April, when the U.S. Justice Department seized the domain name and charged Full Tilt and two other leading poker sites with bank fraud, illegal gambling and money laundering.

Last week, Lederer, Ferguson and Rafael Furst, another Full Tilt director, were accused by DOJ in a civil suit of defrauding thousands of poker players of more than $300 million. The government said the 23 owners of the site had paid themselves $443 million since the site was founded in 2004.

That's quite a take-down. When the site was shut down last spring, it owed $390 million to players around the world but had only $60 million in assets.

"Full Tilt was not a legitimate poker company, but a global Ponzi scheme," said U.S. Attorney Preet Bharara.

This came as quite a shock to the legions of online poker players who still had accounts at the site. Most have a few hundred dollars banked with Full Tilt. Other players have thousands of dollars or more, money they'll probably never fully collect.

As appalling as this alleged fraud is, it's not shocking. Online gambling sites occupy a murky legal realm, attempting to skirt U.S. laws by operating overseas.

So what's the lesson here? Simply that's it's cleaner to play live in a cardroom or casino. When you win, you go to the kiosk and collect your money. You won't lose sleep wondering if you'll be able to cash out.

There are plenty of cardrooms throughout the Bay Area where you can play poker, blackjack and other games, and the atmosphere is more convivial than hunching over a keyboard.

The American-run site was registered in the Channel Islands.

But the Alderney Gambling Control Commission (AGCC) has now revoked its licence after originally suspending it in June.

It comes after a US investigation into money laundering, illegal gambling and bank fraud at Full Tilt Poker that was launched in April.

Eleven people, among them the founders of the site, were charged over the offences.

Prosecutors accuse the website of having plundered player accounts to make payments of tens of millions of pounds to board members.

Andre Wilsenach, executive director of the AGCC, said Full Tilt misled the commission about the amount of money it actually had and carried out "false reporting, unauthorised provision of credit, and failure to report material events".

Gambling laws

Now that the site's licence has been revoked by the AGCC it will no longer have any legal power over the company.

There's been no official comment from Full Tilt Poker.

The site's bosses are reported to have said the move would make it more difficult to pay out the estimated £200 million owed to players.

This is the latest development in a story stretching back several years.

In 2006, American authorities tried to crack down on online gambling.

The Unlawful Internet Gambling Enforcement Act was legislation introduced to try to put the brakes on the emerging industry.

It was designed to halt money transfers to online gaming sites.

As a result several big poker sites worried about the new law have since pulled out of America.

One of those was PokerStars, which is now registered on the Isle of Man and Absolute Poker, which is based in Canada.

A BIDDER for online poker group Full Tilt emerged at the weekend, raising hopes that at least some of the jobs at its Dublin base can be saved.

Alderney’s Gambling Control Commission revoked the group’s licence late last week, after finding that it misled the Channel Island-based regulator about its finances.

The move threw a question mark over the estimated 500 to 600 jobs at Full Tilt’s Pocket Kings subsidiaries in Cherrywood, Dublin, as it meant that the business could not continue to trade.

According to a statement released to a number of online gaming industry websites, French group Bernard Tapie has made a conditional deal to buy Full Tilt’s assets and business and provide funds to repay players.

The news raised the possibility that its licences can be restored and at least some of the jobs in Dublin saved.

Pocket Kings employs more than 500 people in Cherrywood. It is understood that if the Tapie deal goes through, the business may still seek to cut about 250 jobs, as its US operation will remain closed. Pocket Kings said last month it would be seeking to lay off up to 250 people from the Dublin operation. Its London-based spokesperson did not comment yesterday.

The Tapie group’s deal is reported to be subject to the new owner arriving at a “favourable conclusion” with the US department of justice, which has filed a series of complaints against Full Tilt and its Irish subsidiaries with a New York court.

In a statement, the French group said it would seek to open immediate talks with the US department of justice. It did not comment yesterday, but reports suggested that it would be willing to enter talks with the group’s prospective buyer.

The department initially filed bank fraud and money laundering charges against Full Tilt in April. US attorney Preet Bharara followed that up last month with a fresh complaint alleging that the group used $440 million in players’ funds to pay owners and directors. The US authorities maintain that online gambling contravenes a number of federal laws.

The company is also facing a class action suit from former US- based players seeking the return of funds that they say the group owes them. Full Tilt issued a statement earlier this year blaming the seizure of up to $115 million by the US federal authorities and the theft of funds by one of its payment processors.

The Tapie group specialises in corporate rescue and buying distressed businesses. In the late Eighties, it bought sportswear group Adidas from its German owners, the Dassler family. French bank Crédit Lyonnais subsequently took over the company and sold it to Robert Dreyfus.

The group was founded by Bernard Tapie, who served as a French cabinet minister in the Nineties. His son Laurent Tapie is now chief executive of the business. The group claims to have bought and rescued more than 40 businesses.

Mr Tapie also owned Olympique de Marseilles football team, which won a number of French domestic titles in the 1990s and the Champions League in 1993.

It is also believed that the DoylesRoom brand name will then cease to exist and as an ACR representative explained:

In an extraordinary Europe-wide canvassing operation, media organisations associated with Groupe Bernard Tapie have been contacting ex-Full Tilt Poker players by telephone to ask them how they would like to be paid back.

Although this seems like fantastic news for anybody with a bankroll frozen on the Full Tilt Poker web site, there are – of course – strings attached.
The Motive behind the Canvas

The telephone canvasser has been asking the online poker player “warm-up” questions such as:-

What online poker room are you playing on?
How much money do you have stuck in FTP?
Would you play on FTP again?
What were your usual cashout-deposit habits?

Once they have built up a rapport with the interviewee, the canvasser then states that there is a “rumour” that Full Tilt Poker could open again within a matter of weeks, and asks which of the following options the player would prefer as a means of releasing their Full Tilt Poker bankroll.

Investing part of their funds in company shares. This option had already been weighed as a way to reduce the amount of money needed to relaunch the business. Afterwards, players would be able to sell their shares back to FTP and therefore get all their funds back.
Cashout all their account balance with a PENALTY, which would mean a percentage of the whole balance. There is no information on how much this percentage would be.
Small cashouts that would unlock throughout time. FTP would not charge anything for a player to recover their funds but it would take around a year.

The canvasser quickly adds that option number three has been the favoured response to date.
Tapie Still Trying to Avoid Putting Any Money In?

The impression is that Laurent Tapie is trying to find as many ways as possible to relaunch Full Tilt Poker without risking any of his own money. If the majority of players agree to a staggered payout structure over a year, this would enable the company to start drawing income from rake without having to commit $300 million most observers believed would be required in order for Full Tilt Poker to regain its operating license. It also implies that player´s funds will not be segregated from the operating expenses of the company!
Where Did They get The Telephone Numbers From?

The fact that these media companies are only ringing ex-Full Tilt Poker players who had substantial balances on the site means that they must already have access to the Full Tilt Poker database. Apparently a few players have been contacted in Canada, but none in the United States – implying that Groupe Bernard Tapie has either no immediate interest in repaying the debt owed to American online poker players, or it could be an issue that is put on the shelf until the Rest of the World is up and running again.
Barely Credible Marketing Practices

Any number of conclusions can be drawn from this “canvassing” operation. Clearly Groupe Bernard Tapie are adverse to investing money into a discredited online poker company which is just going to be swallowed up by withdrawals, and want to give the impression (to the DoJ/AGCC?) that players will want to continue using the site when it is operational again – and that they are not too bothered about getting their hands on the money which is owed to them immediately.

You can fool some of the people some of the time …

Full Tilt Poker has been surrounded by controversies for the past few months. It started with the poker site being indicted for its operations in the US. The situation became worse when it was not being able to pay its patrons the money it owed them. To add to it, the license of the embattled poker room was revoked by the Alderney Gambling Commission last month. The key reason behind the suspension of the poker room’s license was that some of its operations were not in line with US gambling laws. The situation hasn’t improved but has become worse for the poker room at present. The company is about to lay off about 180 employees.

The poker room’s employees had been warned previously about the possibility of 250 of them being sacked. The decision to send them away came following discussions that took place over four weeks. Full Tilt’s subsidiary had informed redundant employees about their fate. In complaints made by the US Department of Justice, Pocket Kings Ltd has been included in the defendant’s list. One of the biggest accusations made against the company is that it carried out activities which are illegal in the US. As confirmed by the affected employees, statutory redundancies have been offered to them

A few weeks back, Full Tilt had found an investor. With Bernard Tapie’s announcement that it will takeover the poker room, there were hopes that hundreds of jobs would be saved. However, this was subject to how far the legal scenario was favorable for Full Tilt. The situation got worse with fresh charges being brought against the poker room in California.

Greg Omotoy and Lary Kennedy, two prominent names associated with the poker room, have filed a suit against other professionals of the Full Tilt Poker team. The defendants’ list includes Chris Ferguson and Howard Lederer, along with Ray Bitar.

The new lawsuit differs from the previous ones in terms of the request for compensations. The figures in the past lawsuits were between $15 million and $150 million. The new complaint is requesting a compensation of about $900 millions. The defendants have been offered money from the funds in players’ accounts, according to the allegations.

There are also accusations against the poker room that it deducted a rake illegally. Allegations were also made that Full Tilt has made use of its players’ finances for its marketing and operational expenses. Losses and fees from money laundering were also allegedly covered with these funds.

Bwin.Party digital entertainment has confirmed that it wants to re-enter the US online gambling market, and is currently in negotiations with US based gambling groups. The group’s co-Chief Executive Officer, Jim Ryan, said that it aims to create a portal for Bwin.Party with the US companies so that it is poised to enter a legalized and regulated online gambling industry. “We have to be ready for both federal or state,” he said in an interview. “It feels good to have American taxpaying companies finally driving this.”

Party Gaming, before it merged with Bwin to become bwin.party, was once considered the king of US online poker and dominated the market. However, the introduction of the Unlawful Internet Gambling Enforcement Act (UIGEA) of 2006 forced the company to depart the US and concentrate its efforts on other markets instead.

Party Gaming eventually settled with the US Attorney and paid $105 million in US authorities in return for a promise of non prosecution. This paved the way for higher investment activity and the eventual merger with Bwin Entertainment.

Ryan is confident that Bwin.Party will eventually find its way back into the US gambling industry. “It’s not a question of ‘if’, but ‘when’,” he said. However, he wasn’t deluding himself about the tough competition in the gambling industry and the fact that so many companies would be fighting for a piece of the pie once legalization occurs.

“We have to realistic about where we sit in the food chain,” he said. “If the US regulated online poker, it would be unlikely that we would secure a license directly.”
